Terms of Service

To use SwapWithUs you must:

• Be at least 18 years old
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the platform under applicable law
• Provide accurate and truthful registration information

SwapWithUs is currently available to users in the European Union. We reserve the right to restrict access from other regions during this launch phase.

• You may hold only one account. Creating multiple accounts is prohibited.
• You must provide accurate, current, and complete information at registration and keep it updated.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us immediately at [email protected] if you suspect unauthorised access to your account.
• You may not transfer or sell your account to another person.
• Accounts created via Google or Facebook login are subject to those providers' terms in addition to ours.

When you create a listing, you confirm that:

• The information and photos you provide are accurate, truthful, and up to date.
• You own or have the legal right to offer the listed item or property for swapping.
• For home listings: you have the legal right to grant access to the property (e.g. as owner or with the landlord's permission).
• The listing does not infringe any third-party rights.
• You will keep availability dates current and promptly update or remove your listing if it is no longer available.

• A swap is a voluntary, direct arrangement between two users. SwapWithUs facilitates the introduction but is not a party to the swap agreement.
• Users are solely responsible for agreeing the terms of any swap — including dates, condition of items, access arrangements, and any house rules — directly with each other.
• No money is charged between users for a swap. Swaps are free exchanges.
• SwapWithUs does not guarantee that a swap will be completed, that a swap partner will honour their commitment, or that any listed item or property will be as described.
• Any disputes arising from a swap are between the users involved. SwapWithUs has no obligation to intervene but may, at its sole discretion, suspend accounts involved in reported misconduct.

You must not use the platform to:

• Post false, misleading, or fraudulent listings or information
• Impersonate another person or entity
• Harass, threaten, or discriminate against other users
• Collect or scrape user data without our written permission
• Use automated tools, bots, or scripts to access the platform
• Attempt to gain unauthorised access to other accounts or platform infrastructure
• Conduct commercial transactions disguised as swaps (e.g. charging money for a listed item)
• Violate any applicable law or regulation, including export control or sanctions laws
• Upload or transmit malware, viruses, or harmful code
• Post content that is illegal, obscene, or infringes a third party's intellectual property rights

We reserve the right to remove content and suspend or permanently ban accounts that violate these rules, without prior notice.

You retain ownership of all content you upload to the platform. By submitting content, you grant SwapWithUs a non-exclusive, royalty-free, worldwide licence to store, display, and distribute your content solely for the purpose of operating and promoting the platform. This licence ends when you delete the content or your account.

You confirm that any content you submit does not infringe the intellectual property rights, privacy rights, or any other rights of a third party.

The SwapWithUs name, logo, and platform design are the intellectual property of SwapWithUs Oy. You may not reproduce or use them without our prior written consent.

By you: You may delete your account at any time from Profile → Settings → Delete Account. Upon deletion, your personal data will be erased as described in our Privacy Policy, except where retention is required by law.

By us: We may suspend or terminate your account without prior notice if you breach these Terms, engage in fraudulent activity, or if continued access poses a risk to other users or the platform. We will inform you of the reason unless doing so would compromise an ongoing investigation or is prohibited by law.

Termination does not affect any obligations that arose prior to termination.

If you have a complaint about SwapWithUs, please contact us first at [email protected]. We will make reasonable efforts to resolve your complaint promptly.

If we cannot resolve the complaint directly, you may refer your dispute to the Finnish Consumer Disputes Board (Kuluttajariitalautakunta — kuluttajariita.fi) or use the European Commission's Online Dispute Resolution platform:

These Terms are governed by and construed in accordance with the laws of Finland, without regard to conflict of law principles.

If you are a consumer resident in another EU member state, you also benefit from the mandatory consumer protection laws of your country of residence. Nothing in these Terms overrides those protections.

We may update these Terms from time to time. If we make a material change, we will notify you by email at least 14 days before it takes effect. The "Last updated" date at the top reflects the current version. Continued use of the platform after the effective date of the new Terms constitutes your acceptance. If you do not accept the updated Terms, you must stop using the platform and may delete your account.
